Is Iddah Compulsory After Khula:

Whether Iddah is compulsory after khula is a religious and legal question at the same time. When a female obtains khula from the family court or the Qazi, then generally yes, she has to observe the Iddah period. Legally, after the khula in Pakistan, the female has to mandatorily observe the Iddah period because after the Iddah period, only she will be issued the divorce certificate. The divorce certificate in Pakistan is issued by a software that mentions the date of khula and the date of failure of reconciliation. These two dates should have a 90-day difference; otherwise, the certificate will not be issued. Religiously, there are a few conditions when a female doesn’t have to observe the Iddah period.

When There is No Rukhsati:

 The main purpose of the Iddah, or the waiting period for the female after the khula, is to see if the female gets pregnant or not after the divorce, so that there may not be confusion regarding the father of the child. If there was no rukhsati, which means that there was no physical relationship between the husband and the wife. In this situation, there will be no need for the female to observe the Iddah period.

When There is No Consummation of Marriage:

When the marriage between the male and the female was not consummated for any reason, then there is no need for the female to observe the Iddah period. For example, if the husband was in the UAE for the last two years and the female took khula, then there will be no need for Iddah of the female.

Non-Muslim Females:

 The Iddah is the waiting period after the divorce, which is 90 days. This waiting period is for Muslim females, and the Muslim law does not apply to non-Muslims in the world. A non-Muslim female in Pakistan doesn’t need to observe the Iddah period. This rule is only for Muslim females.

When a Female has not Attain Puberty:

When a married female is a minor, and she has not attained the age of puberty, then there is no need for the Iddah period. A female who has not attained the age of puberty cannot conceive a baby, so there is no need for the Iddah period. Iddah is compulsory after khula, but not for the minor females.

When the Female Has Acceded her age:

When the female taking khula has acceded her age, then she doesn’t need to observe the Iddah period after the khula. By the word “acceding,” the age means that the female has passed away from the age when she can conceive a baby. For example, if a female aged 60 years has taken khula from the husband and she doesn’t know when she gets her menstrual period, then she doesn’t have to observe the Iddah period.

After The Child Birth, When the period Stop:

If the female taking khula is already pregnant and she delivers the child, in this case, she doesn’t have to observe the Iddah period once her menstrual cycle stops.
