Automatic Divorce After Long Separation in Islam

There is no concept of automatic divorce after long separation in Islam. The religion of Islam does not give a free hand to the male or the female to start considering themselves divorced only because they have not been living together for a long period.

If the husband and wife are not living together for a short or even a longer period, it does not mean that they are now divorced. The relationship and the marriage bond remain intact even if they are not living together for a long period.

No husband or wife can assume themselves to be divorced only because they have been separated for a long time.

Wife Has to File Khula

There is no automatic divorce after long separation in Islam.

If a wife does not want to live with her husband or wants to break the relationship and end the matrimonial bond between them, she has to file a case of Khula in Pakistan before the Family Court.

Khula Procedure:

The wife has to file a case before the Family Court through a lawyer.
This is the legal way for a wife to end the matrimonial bond.
If she wants to end the relationship, she has to seek a Khula decree from the Family Court.

She Has to Leave Her Haq Mahr

Both Islamic Law and Pakistani Law place a condition on a wife that if she seeks divorce from her husband through Khula, she has to leave her Haq Mahr.

Haq Mahr is the dower amount that the husband is bound to pay to the wife in case of divorce in Pakistan.

Haq Mahr in Khula:

If the wife herself is demanding divorce and has filed a Khula case, she has to leave all or a large portion of her Haq Mahr in favor of the husband.
If she has already received the Haq Mahr or dower amount, she may have to surrender all or part of that amount to the husband.
The Family Court can also issue a conditional decree stating that if she has obtained the Haq Mahr, she has to return it to the husband.

Long Separation is a Valid Ground for Khula

Although long separation does not mean automatic divorce, it can still be a valid ground for Khula.

If the husband and wife have not been living together for a long period, the wife is entitled to file a Khula case before the Family Court on the ground that they have been living separately for a long time.

Valid Ground for Khula:

Long separation may be used as a ground for seeking Khula.
A wife seeking divorce in Pakistan may file a Khula case on this basis.
The Family Court may consider this ground while deciding the case.

Wife Cannot Marry Someone Else Without Divorce

A wife cannot marry someone else without obtaining a divorce certificate in Pakistan.

The fact that she has not been living with her husband for a long period does not allow her to marry another person.

Important Points:

Long separation does not give a wife the right to marry someone else.
It will be a crime under Pakistani Law.
It will also be a sin according to the religion of Islam.
If the wife wants to marry someone else, she has to obtain a Khula decree from the court.

Legal Requirements Should Be Completed

After obtaining the signatures of both parties, the lawyer will process the divorce case.
The lawyer will then obtain the divorce certificate for them.

The proof of divorce in law is the divorce certificate.

Divorce Certificate:

It is the final document issued after the complete divorce procedure is finalized.
It serves as legal proof that the marriage has ended.
