Can Court Finalize Divorce Without Husband’s Approval in Pakistan?
Yes, the court can finalize the divorce without the husband’s approval. The court is not bound by the husband’s approval. Moreover, Khula has nothing to do with the approval or disapproval of the husband.
If a wife needs a divorce from the husband in Pakistan, she has to file a case in the family court. Therefore, it should be kept clear that Khula is granted by the family court and not by the husband. A female who files a case in the family court is seeking Khula from the court and not from the husband. Therefore, the husband’s approval or disapproval has nothing to do with the Khula decree.
In fact, a case of Khula is filed in the family court only when the husband is not ready to divorce the wife. If the husband is ready to divorce the wife, then she does not even need to file a case of Khula as per the law of khula in Pakistan. She can process a mutual divorce before the Arbitration Council.
Mutual Divorce
If the husband is ready to divorce the wife, either on his own or on the request of the wife, then the wife does not need to file a case of Khula. She can process her mutual divorce case before the Arbitration Council.
The Khula procedure in Pakistan is initiated only when the husband is not ready to divorce the wife or when the husband does not approve the request for divorce from the wife.
Khula Case
A Khula case is filed by the wife when the husband is not ready to divorce the wife. In a case of Khula, the wife is seeking Khula from the court and not from the husband. Therefore, approval is not required from the husband; it is required from the court.
The Khula procedure in Pakistan is initiated by the wife on the basis of certain reasons which she has to establish before the court. If the court considers that the reasons exist, then the court will issue the Khula decree in favor of the wife. In this procedure, the husband’s approval is not required.
However, the husband will be sent a notice that if he wants to contest the case, he can appear before the court and contest the case.
Talaq-e-Tafweez
Sometimes the husband has delegated his right of divorce to the wife, and this right is also mentioned in the Nikahnama. The registered Nikahnama mentions whether the wife has this right or not.
In case the husband has delegated this right to the wife, then the wife does not need to file a case of Khula. She can also divorce herself in the same way that the husband can arbitrarily divorce the wife.
She does not need the approval of the husband in order to exercise her right of Talaq-e-Tafweez. However, the husband has the right to cancel this delegated right which he has already granted to the wife and which is mentioned in the marriage certificate in Pakistan.
