DO I Have to attend Court Hearing in Khula Case?
No, you don’t need to attend a court hearing in a khula case. The khula case is filed through a lawyer. When you have hired the services of a lawyer, the lawyer will do the job. When you hire a lawyer, you give him the power of attorney, which means that he will be representing you in the court of law. When you are already being represented by a lawyer, then you don’t have to attend court hearings in the khula case. When the services of a lawyer are taken, then the lawyer asks you to sign a document also known as wakaltnama. Through this document, you give complete power to the lawyer to attend the court hearings on your behalf. A female doesn’t have to attend the court hearings except on one date, which is fixed for evidence.
Evidence:
Every case in the court requires to be proved in the court. When a family case or the case of khula in Pakistan is filed in the court, the court gives a date for evidence. On this date, the female and her lawyer have to prove that the contents of the case filed are true and correct. For this purpose, the female has to appear in the court herself. When the female appears in the court, the court marks her attendance and takes her picture on the order sheet as proof that she was present. The female needs to be present in the court because the court also has to confirm that it was the female who actually filed the case. This is a sort of confirmation from the court that the petitioner is genuine.
Other than the date of evidence, the female who filed the case of divorce in Pakistan doesn’t have to attend the court hearing. The rest of the court hearings are conducted through a lawyer. When the lawyer representing you does, then the lawyer on your behalf marks your attendance and conducts the proceedings. When a Female is Abroad:
When the wife who filed the case of khula is abroad, she doesn’t even have to be present in the court on the date of evidence. When the female is abroad, she hires a lawyer through a special power of attorney. This special power of attorney authorizes your lawyer to not only represent you in court but also tender your evidence in court. The females—those who are abroad, irrespective of whether they are Pakistani nationals or foreign nationals—don’t have to come to Pakistan for court hearings.
