Wife right To Separation in Islam:

A wife’s right to separation in Islam is completely secured. The religion and the Pakistani law both allow a female to obtain a divorce from her husband through the procedure of khula in Pakistan. In Islam, marriage is a contract between the husband and wife. The religion of Islam does not force the couple to live in a toxic relationship. If the husband and the wife don’t want to live with each other, they can get a divorce. The male is given the arbitrary right to divorce the wife, and the wife has also been given the right to obtain the divorce, which is called khula. For khula, the wife should have a valid reason in order to obtain the divorce. The wife, in order to obtain the divorce, has to file the khula case in the court through a lawyer.

However, if the husband wants to divorce the wife, he has to give the dower amount to the wife, which was fixed at the time of marriage. When a Muslim marriage is solemnized, the dower amount is fixed at that time. The deferred amount of dower is mentioned in the marriage certificate. The amount of dowry is fixed by the bride. She has the right to mention any amount that her husband has to pay in case of divorce. Once the divorce is finalized, he is issued a Nadra divorce certificate as proof that he is now divorced.

 This secures the complete wife’s right to separation in Islam. Some of the people mix the word separation with divorce in Pakistan. Separation is not divorce. A Muslim female doesn’t need to have a separation order from the court in order to get the khula. The separation orders are generally required for non-Muslim females. Separation is one of the key grounds for non-Muslim females to get a divorce in Pakistan from the court. The Muslim female can get the khula from the court on some other grounds also, such as mental and physical torture, non-maintenance, etc.

The wife’s right to separation in Islam is guaranteed in the religion and the Pakistani law. If a female needs a divorce from her husband, all she needs to do is file the case through a lawyer in Pakistan. The Pakistani law is lenient for females. In Pakistan, females get divorced in only two months. The wife’s right to separation in Islam means that she has the right to get a divorce from her husband. In other religions, this right is very limited, as they consider marriage a sacred sacrament. In Islam, marriage is a contract. If the bride and the groom don’t want to continue with the contract, they have the right to the matrimonial bond. Once the divorce is completed, the male and the female can get married again or even have a court marriage in Pakistan.
