What Evidence is Need for Khula?

What Evidence is need for Khula:

What evidence is needed for khula in Pakistan depends on the circumstances of each case. Some people mix up the documents required to file the case of khula with the evidence needed for khula in Pakistan. The documents required to file a case in the family court of Pakistan include the marriage certificate and ID card, whereas the evidence required to obtain the decision in your favor is other than the documents required. If a female needs a khula in Pakistan, she should have a valid reason to establish it in the family court. These reasons can be established by way of oral and documentary evidence. The oral and documentary evidence are different in each case. When your lawyer drafts the case of khula, he also keeps in mind the evidence provided by the client.

The evidence needed for khula can be divided into two parts as follows.

Oral Evidence:

If you don’t have documentary evidence in support of your khula case in the court, then in the absence of the documentary evidence, you can bring at least two witnesses to support the case of khula. These witnesses, through the lawyer, tender their affidavit on oath stating that the contents of the case filed for khula are true and correct. Preparing a case and the affidavit requires expertise, which the divorce lawyers are good at. If you have hired the services of a good divorce lawyer in Pakistan, then you don’t need to worry about the drafting of the case and the affidavits; they will manage everything in time and with expertise.

Documentary Evidence:

Documentary evidence is of a higher status than oral evidence. If you have any documentary evidence in support of your khula case, it is always recommended to provide it to your lawyer. Once the lawyer gets the documentary evidence in support of your claim, he attaches it to the case file. This documentary evidence makes it easy for the lawyer to argue your case. It also makes it easy for the judge to decide the case in your favor.

Example:

For example, if you state in the khula case that the husband used to torture the wife, and you have the medical report in your favor, then it is always good for your case. This medical report supports your claim in court and makes the case easy for your lawyer. The easier the case is for the lawyer, the quicker you get the decision.

For example, if you claim in court that the husband has done a second marriage without your permission and you attach the marriage certificate of the second marriage of your husband, then it supports your claim. When you support your claim with documentary evidence, you increase your chances of winning the case. The more supporting documents you attach to your file or tender at the stage of evidence, the more quickly you get the decision in your favor from the judge.
