Will I Get Financial Support after Khula?

 The husband is legally bound to provide financial support to the wife, irrespective of the fact that the wife is rich or the husband is poor. Even if the husband is poor and the wife is rich, the husband is duty-bound to maintain his wife, but after the khula, the wife is no longer the wife. When a wife is no longer a wife, she is not entitled to any financial support from the ex-husband. The husband becomes an ex-husband and becomes a non-mehram for the female, so she is not entitled to any financial support from the husband. A female does not get any financial support after khula in Pakistan except for the period of iddat.

Iddat Period:

 After the khula from the court, the iddat period starts for the female. This iddat period is of 90 days starting from the day when the khula decree was announced by the court. As per the family law in Pakistan, the wife is entitled to the maintenance amount till the period of iddat. A female can claim financial support from her husband from the day after the marriage, when she was denied financial support till the period of iddat. Once the iddat expires she receives a divorce certificate in Pakistan after which she is not entitled to any financial support from husband.

Example:

 If a female got married in 2020, and since 2022 onwards she has not received any financial support from the husband, then she can file a case for khula, and she can also claim the financial support in the court from 2022 till her period of iddat. The female has to bear in mind that the burden of proof is on her to prove that her husband has not maintained her since 2022.

File case of Khula & Wife Maintenance in Pakistan:

When a female needs a khula from the husband on the grounds that no financial support was given by the husband, then she has the right to file the case of khula and wife maintenance in Pakistan altogether. The lawyer will draft both cases in the same petition and file it in the court.

Financial Support of Children:

The wife does not remain a wife after khula, but the children remain the children even after the khula. Child maintenance in Pakistan has nothing to do with the khula decree. The father of the children is duty-bound to provide the financial support to the children irrespective of the fact that the husband gave a divorce to the wife or the wife applied for khula. If the father fails to provide financial support to the children, then the mother of the children can file a case in court for the financial support of the children. If the father has custody of the children, then the mother of the children cannot claim the financial support of the children because they are already maintained by the father.
